Terms of sale
1. Who you are buying from
Everything sold on imposter.wtf is sold by imposter., Italy, contactable at notyetimposter@gmail.com.
In these terms, "we" and "us" mean the seller named above, and "you" means the person placing the order. "Consumer" means a natural person acting for purposes outside their trade, business, craft or profession.
2. What these terms cover
These terms govern every contract of sale concluded through this site. They are made available to you before you place your order, and you are asked to accept them as part of ordering. A copy is available on this page at any time and can be saved or printed.
We may change these terms. The version in force is the one published on this page at the moment you place your order, and a change made afterwards does not affect an order already placed.
Where you are a consumer, nothing in these terms limits or excludes the rights the law gives you that cannot be limited or excluded by agreement.
3. The posters
Every poster is printed to order. Nothing is held in stock.
Posters are sold unframed. Where a frame appears in a photograph on this site, it belongs to the photograph and is not included in what you are buying.
Sizes are stated on each product page in inches and in centimetres. Paper and printing are described on the home page and are the same for every poster unless a product page says otherwise.
Colours shown on a screen are a reproduction. Screens differ from each other and from ink on paper, and a reasonable difference between what you saw and what arrives is not a defect. A difference that goes beyond that is dealt with under section 9.
Where a poster is described as a limited or numbered version, we do not undertake to reprint it once that version is sold out.
4. Prices, taxes and duties
Prices are shown in United States dollars and include any tax we are required to charge at the point of sale. The price you pay is the price displayed at the moment you complete your order.
Delivery is charged at $8 per order to every destination we ship to, and is not charged on orders over $70. The delivery charge is shown before you pay.
If your delivery address is outside the customs territory in which your order is produced, import duties, taxes or customs handling fees may be charged by the authorities of the destination country. Those charges are not included in the price, are not collected by us, and are payable by you. We have no control over them and cannot tell you in advance what they will be.
If a price is shown that is obviously wrong — for example by a factor of ten — and the error should reasonably have been apparent to you, we may cancel the order and refund you in full rather than supply at that price.
5. How an order is made
You select the items and sizes you want, you go to the basket, and you are taken to a payment page where you enter your delivery and payment details. The final step is a button that states that placing the order carries an obligation to pay.
Before that final step you can go back and change what is in your basket, the sizes, and the delivery details.
The contract between us is concluded when we send you an order confirmation by email. That email contains an order number, what you bought, the amount paid, the delivery address, and a link to this page.
If we cannot fulfil an order — for example because a print file is unavailable or we cannot ship to your address — we will tell you and refund you in full. No contract is concluded in that case.
6. Payment
Payment is taken at the moment you place the order, by card or by such other methods as are offered at the payment page.
Payment is processed by our payment processor. We do not receive or store your card details.
If a payment is reversed, charged back or otherwise fails after we have shipped, we may require payment or the return of the goods before dealing with any further order from you.
7. Printing and delivery
Orders are printed at the production facility nearest to your delivery address and shipped from there.
The delivery window shown in your confirmation email is our supplier's estimate for your address, and is an estimate and not a guaranteed date. It is not a term of the contract.
If we have not delivered within thirty days of the contract being concluded, and you are a consumer, you may set us an additional period appropriate to the circumstances, and if we do not deliver within that period you may terminate the contract and we will refund you in full without undue delay.
Where you are a consumer, the goods are at our risk until they come into your physical possession, or into the physical possession of a person you have named to receive them, other than the carrier.
You are responsible for the accuracy of the delivery address you give us. If a parcel is returned to the sender because the address was wrong or incomplete, or because nobody collected it, we will refund the price of the goods but not the cost of delivery, and any re-delivery is a new order.
8. Right of withdrawal for consumers in the EU, EEA and UK
If you are a consumer resident in the European Union, the European Economic Area or the United Kingdom, you have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period expires 14 days from the day on which you, or a third party other than the carrier indicated by you, acquires physical possession of the goods. Where an order is delivered in several parcels, it expires 14 days from the day you acquire possession of the last parcel.
To exercise the right of withdrawal you must inform us of your decision by an unequivocal statement, sent to notyetimposter@gmail.com. You may use the model withdrawal form set out in the Returns and refunds notice, but you are not obliged to. To meet the deadline it is enough that you send your communication before the period expires.
The right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised. We do not make personalised posters, so in practice this exception does not apply to anything we sell.
The consequences of withdrawal, including what is refunded and what is not, are set out in the Returns and refunds notice, which forms part of these terms.
9. If something is wrong with what you receive
We must deliver goods that conform to the contract. Where you are a consumer resident in the EU or the EEA, we are liable under Directive (EU) 2019/771, as implemented in Italy in the Codice del Consumo, for any lack of conformity existing at the time of delivery and becoming apparent within two years of delivery. Where the lack of conformity becomes apparent within one year of delivery, it is presumed to have existed at the time of delivery unless we prove otherwise.
In that case you are entitled to have the goods brought into conformity, by repair or replacement, or to a proportionate reduction in price or termination of the contract in the cases the law allows. Bringing the goods into conformity is free of charge to you.
Where you are not covered by those provisions, we will replace or refund any item that arrives damaged, defective, or different from what you ordered, at our cost, on the terms set out in the Returns and refunds notice.
Tell us as soon as you reasonably can, and keep the packaging: for transit damage the carrier will normally require photographs of both the item and the box or tube it arrived in.
10. Our liability
We are liable to you for foreseeable loss and damage caused by our failure to perform this contract with reasonable care and skill, or by our failure to supply goods that conform to it.
We do not exclude or limit our liability in any way where it would be unlawful to do so. That includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and any liability under mandatory consumer protection law.
Where you are not a consumer, we are not liable for loss of profit, loss of business, business interruption or loss of business opportunity, and our total liability arising out of or in connection with an order is limited to the amount you paid for that order.
11. Intellectual property
The designs, artwork, photographs, text and the imposter. name and marks on this site belong to us or are used by us with permission. Buying a poster gives you the printed object and nothing else.
You may not reproduce, scan, re-print, distribute, or make derivative works from the artwork, and you may not use it commercially, including printing it on other objects for sale.
Hanging it wherever you like, photographing your own wall, and posting that photograph, are all fine.
12. Using the site
You may not attempt to gain unauthorised access to any part of the site or its systems, interfere with its operation, or use automated means to place orders or to copy its content in bulk.
13. Governing law and disputes
These terms and any contract concluded under them are governed by Italian law.
If you are a consumer, this choice of law does not deprive you of the protection afforded to you by provisions that cannot be derogated from by agreement under the law of the country in which you have your habitual residence, in accordance with Article 6 of Regulation (EC) No 593/2008.
If you are a consumer resident in the European Union, the courts of the place of your residence have jurisdiction, and you may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.
If you are not a consumer, the courts of Italy have exclusive jurisdiction.
